1. Acceptance of terms
By accessing or using Active Bio Labs, you agree to be bound by these Terms. If you do not agree, do not use the site.
2. Eligibility
You must be at least 21 years old, located in the United States, and you represent that you are a qualified researcher, institution, or organisation acquiring materials solely for in-vitro laboratory research.
3. Research-use-only supply
All materials are supplied strictly for in-vitro laboratory research and educational purposes. They are not drugs, foods, cosmetics or medical devices, they are not approved by the FDA for any therapeutic use, and they are not for human or animal consumption. You are solely responsible for handling, storage, use and disposal in accordance with applicable law and the safety practices of your facility.
4. Your representations
You represent and warrant that you will not administer any material to a human or an animal, will not resell or repackage it for any such use, and will not describe it as safe or effective for any therapeutic purpose. Any use outside these terms is a breach of this agreement and is entirely at your own risk.
5. Orders and pricing
Active Bio Labs may refuse, limit or cancel any order at its sole discretion, including where a registration appears inaccurate or where a request is inconsistent with research-only supply. Wholesale pricing requires approval and is subject to minimum order values shown at checkout.
6. Warranty disclaimer
Materials are provided “as is” for research use. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Analytical data, where provided, describes the tested lot only.
7. Limitation of liability
To the fullest extent permitted by law, Active Bio Labs is not liable for any indirect, incidental, special, consequential or punitive damages, or for any personal injury, loss or damage arising from use of a material outside its stated in-vitro research purpose. Our total aggregate liability for any claim is limited to the amount you paid for the specific order giving rise to the claim.
8. Indemnification
You agree to indemnify and hold harmless Active Bio Labs and its officers, employees and suppliers from any claim, loss or expense arising from your use, handling or onward transfer of any material, or from your breach of these Terms.
9. Privacy
Our handling of registration and order information, including encryption and retention periods, is described in our Privacy Notice.
10. Governing law
These Terms are governed by the laws of the State of Delaware and the federal laws of the United States applicable there, and you submit to the exclusive jurisdiction of its courts.
